ThiscontractualWarrantyappliesonlytothehardwarecomponentsofXiaomiProduct(hereafter“Product”)asoriginallysuppliedanddoesnotapplytoanysoftwareorotherequipmentthatareownedbyXiaomiorthirdpartiesforwhichanend-userlicenseagreementorseparatewarranty/guaranteestatementsorexclusionsareprovidedorintendedtoapply. LIMITEDPRODUCTWARRANTY XiaomiwarrantstheoriginalpurchaserthatyourXiaomiProductshallbefreefromdefectsinmaterialsandworkmanshipundernormaluseduringthewarrantyperiod.Exceptotherwiseprovidedbyapplicablelaw,thewarrantylastsandisprovidedforone(1)yearforhostunit,six(6)monthsforremovablebatteryandcharger,one(1)yearforirremovablebattery,three(3)monthsforEarphoneifapplicablefromthedateofpurchase.Notwithstandingtheforegoingclause,Xiaomidoesnotexclude,limitorsuspendtheminimumlegalwarrantyperiodimposedbyapplicablelaw. XiaomidoesnotwarranttheoperationoftheProductwillbeuninterruptedorerror-free. REMEDIES IfahardwaredefectisfoundandavalidclaimisreceivedbyXiaomiwithintheWarrantyPeriod,Xiaomiwilleither(1)repairtheProductatnocharge,useneworrefurbishedreplacementparts,(2)replacetheProductwithaneworrefurbishedproduct,or(3)refundtheProduct,excludingpotentialshippingcosts. Intheeventofadefect,tothefullestextentpermittedbylaw,theseareyoursoleandexclusiveremedies.Shippingandhandlingchargesmayapplyexceptwhereprohibitedbyapplicablelaw. Anyreplacementhardwareproductwillbewarrantedfortheremainderoftheoriginalwarrantyperiodorthirty(30)days,whicheverislonger,orforanyadditionalperiodoftimethatmaybeapplicableinyourjurisdiction. HOWTOOBTAINWARRANTYSERVICE Inaccordancewithapplicablelaw,XiaomimayrequirethecustomertofurnishproofofpurchasedetailsandwarrantycardwithIMEIoftheProduct.Itisyourresponsibilitytobackupanydata,software,orothermaterialsyoumayhavestoredorpreservedontheproduct.Itislikelythatsuchdata,software,orothermaterialswillbelostorreformattedduringservice,andXiaomiwillnotberesponsibleforanysuchdamageorloss. EXCLUSIONSANDLIMITATIONS UnlessotherwisestipulatedbyXiaomi,thisLimitedWarrantyappliesonlytotheProductmanufacturedbyorforXiaomi,thatcanbeidentifiedbythe"Xiaomi"or“Mi”trademark,tradename,orlogoaffixedtoit. TheLimitedWarrantydoesnotapplytoany:(a)DamageduetoactsofnatureorGod,forexample,lightningstrikes,tornadoesflood,fire,earthquakeorotherexternalcauses;(b)Negligence;(c)Commercialuse;(d)AlterationsormodificationstoanypartoftheProduct;(e)Damagecausedbyusewithnon-Xiaomiproducts;(f)Damagecausedbyaccident,abuse,ormisuse;(g)DamagecausedbyoperatingtheProductoutsidethepermittedorintendedusesdescribedbyXiaomiorwithimpropervoltageorpowersupply;(h)Damagecausedbyservice(includingupgradesandexpansions)performedbyanyonewhoisnotarepresentativeofXiaomior(i)failuretofollowinstructionsrelatingtotheProduct'susage. RecoveryandreinstallationofsoftwareprogramsanduserdataarenotcoveredunderthisLimitedWarranty.NoXiaomireseller,agent,oremployeeisauthorizedtomakeanymodification,extension,oradditiontothisLimitedWarranty.Ifanytermisheldtobeillegalorunenforceable,thelegalityorenforceabilityoftheremainingtermsshallnotbeaffectedorimpaired. ExceptasprohibitedbylawsorotherwisepromisedbyXiaomi,theafter-salesservicesshallbelimitedtothecountryorregionoftheoriginalpurchase. Productswhichwerenotdulyimportedand/orwerenotdulymanufacturedbyXiaomiand/orwerenotdulyacquiredfromXiaomioraXiaomi’sofficialsellerarenotcoveredbythepresentwarranties.Asperapplicablelawyoumaybenefitfromwarrantiesfromthenon-officialretailerwhosoldtheproduct.Therefore,Xiaomiinvitesyoutocontacttheretailerfromwhomyoupurchasedtheproduct. ThepresentwarrantiesdonotapplyinHongKongandTaiwan. IMPLIEDWARRANTIES Exceptprohibitedbyapplicablelaw,allimpliedwarranties(includingwarrantiesofmerchantabilityandfitnessforaparticularpurpose)shallbelimitedtothedurationofthislimitedwarranty.Somejurisdictionsdonotallowlimitationsonthedurationofanimpliedwarranty,sotheabovelimitationmaynotapplytoyou. LIMITATIONOFDAMAGES Exceptprohibitedbyapplicablelaw,Xiaomishallnotbeliableforanyincidental,indirect,special,orconsequentialdamages,includingbutnotlimitedtolossofprofits,revenueordata,damagesresultingfromanybreachofexpressorimpliedwarrantyorcondition,orunderanyotherlegaltheory,evenwhenXiaomihasbeenadvisedofthepossibilityofsuchdamages. Somejurisdictionsdonotallowtheexclusionorlimitationofspecial,indirect,incidentalorconsequentialdamages,sotheabovelimitationorexclusionmaynotapplytoyou.
