Issuedundertheauthorityof theMinisterofInnovation,ScienceandIndustry MartinProulx DirectorGeneral Engineering,PlanningandStandardsBranch 1.Background InJune2019,Innovation,ScienceandEconomicDevelopmentCanada(ISED),onbehalfoftheMinisterofInnovation,ScienceandEconomicDevelopment,publishedaDecisiononReleasingMillimetreWaveSpectrumtoSupport5G(“theDecision”)throughCanadaGazettenoticeSLPB-003-19.Furthermore,inApril2021,ISEDreleasedSAB-002-21,MoratoriumontheLicensingofEarthStationsintheFrequencyBands26.5-28.35GHzand37.5-40.0GHzinCertainAreas.ThroughtheDecision,ISEDindicatedthatitwillconsultonthelicensingframeworkforflexibleuse,updateearthstationlicensingrulesanddevelopcoordinationrulesinthefuture.Aswell,ISEDstatedthatuntiltheearthstationlicensingrulesandcoordinationrulesarefinalized,earthstationsinthemillimetrewavebandswillbelicensedinaccordancewithaninterimlicensingguideline.Therefore,ISEDwillbeapplyingtheinterimrulesspecifiedinthisdocumenttofacilitatethelicensingofEarthexploration-satelliteservice(EESS)andspaceresearchservice(SRS)earthstationsinthefrequencyband26.5-27.0GHz,andfixed-satelliteservice(FSS)earthstationsinthefrequencybands27.0-28.35GHzand37.5-40.0GHz. 2.Intent ThisguidelinewillbeusedinallcaseswhereprospectivelicenseesapplytoISEDtoseekauthorizationsforEESSandSRSearthstationsinthefrequencyband26.5-27.0GHz,andFSSearthstationsinthefrequencybands27.0-28.35GHzand37.5-40.0GHz,andwherecurrentlicenseesrequestamendmentstoexistingsatelliteearthstationlicencesaslistedinannexesAandBofthisdocument.ThisguidelinealsodescribestherequirementsforexistinglicenseeswhomustprovideinformationontheiroperationsrelatingtotheirtransmitcontoursasdiscussedintheDecision. ThisguidelinewillremainineffectuntilISEDadoptsearthstationlicensingandcoordinationrulestofacilitatesharingbetweenEESS/SRS/FSSearthstationsandflexibleusesystems.Otherlicensingrequirementsforearthstationapplications(suchasthosespecifiedinCPC-2-6-01,ProcedurefortheSubmissionofApplicationstoLicenseFixedEarthStationsandtoApprovetheUseofForeignSatellitesinCanada)andalltherelevantprovisionsoftheRadiocommunicationActandRadiocommunicationRegulationscontinuetoapply. AsindicatedintheDecision,ISEDrecognizestheimportantandoftencriticalroleofsatellitecommunicationsinprovidingconnectivityinruralandremoteareassuchastheNorth.Tofacilitateearthstationdeploymentintheseareas,ISEDintendstoconsult,throughthelicensingframeworkconsultation,onasetofspecificareasthatcouldbeaffordedsomeflexibilitywhenapplyingthelicensingandcoordinationrules.InGL-10,issue2,flexibilityisprovidedtoearthstationsoperatingincertainareas.AnnexCcontainsapreliminarylistofTier4serviceareasinwhichearthstationsareexemptedfromcertainprovisions.Giventhatthislistissubjecttofutureconsultation,theflexibilityprovidedtoearthstationsoperatingintheseserviceareas(includingrelaxationofcertainrulesorexemptionfromcertainprovisions;seesection3)isonaprovisionalbasis.Dependingontheresultoftheconsultation,theseearthstationsmayberequiredtocomplywithadditionalprovisions,includingthosefromwhichtheyarecurrentlyexempt.NotethatalthoughTier4serviceareasareusedthroughoutthisdocument,thedecisiononflexibleuselicenceareaswillbedevelopedthroughanupcominglicensingframeworkconsultation. AuthorizationforanearthstationobtainedunderGL-10,issue2,mayalsobesubjecttothelicensingandcoordinationrulestobeestablishedinthefuture.ISEDintendstogatherexperienceontheuseofthisguidelinetodevelopthelicensingandcoordinationrules,andmaymodifythisguidelineasrequired. Receivecontour Thereceivecontourisintendedtorepresentaregionwithinwhichthereisapotentialthattheoperationofaflexibleuseservicesystemmaycauseharmfulinterferencetotheoperationoftheearthstation. Simplepolygon Asimplepolygonisashapeconsistingofstraight,non-intersectinglinesegmentsor“sides”thatarejoinedpair-wisetoformaclosedshapewithnoholes. Spectrumgridcell AsdefinedinServiceareasforcompetitivelicensing,issue4,October2015:Theminimumsizeofthegridcellis1minutelatitude×1minutelongitude.Largersquaregridcells,e.g.3 minute ×3 minutecellsor15 minute×15 minutecells,areimplementedforinteriorsofserviceareaswherefinegranularityisnotrequired. Transmitcontour Thetransmitcontourisintendedtorepresentaregionwithinwhichflexibleuseservicesystemsmayexperienceharmfulinterferencefromtheemissionsoftheproposedearthstation. 3.Licensingguidelinesfornewearthstations AnapplicationforareceivingEESS,SRSandFSSearthstationlicenceinthefrequencybands26.5-27.0GHzand37.5-40.0GHz,oranapplicationforatransmittingFSSearthstationlicenceinthefrequencyband27.0-28.35GHzmustincludeareceivecontouroratransmitcontour.Acontourisrequiredforeachrelevantfrequencyblockinthe26.5-28.35GHzand37.5-40.0GHz.Thebandplansareillustratedinfigures1and2,respectively.Forthepurposeofapplyingthisguideline,thefrequencyband37.5-37.6GHzshallbetreatedasanindividual100MHzfrequencyblock. AsindicatedintheDecision,ISEDwilldevelopcoordinationrulesusingapopulation-impactbasedapproachtoenablecoexistencebetweenflexibleusestationsandsatelliteearthstationsinthemillimetrewavebands.Specifically,thisapproachwillsetlimitsonearthstationdeploymentsuchthatitsdeploymentwouldnotaffectamaterialamountofthepopulationinagivenflexibleuselicencearea. Fortransmittingearthstations,ISEDcouldestablishexclusionzoneswhereflexibleusesystemswouldnotbeabletoclaimprotectionunlessanagreementisreachedbetweenthelicensees. Forreceivingearthstations,protectionzonescouldbeestablishedwhereflexibleusesystemswouldonlybeabletodeployuponsuccessfulcoordinationwithearthstationlicensees. Inordertoestablishthesezones,thetransmit/receivecontoursdescribedbelowcouldbeused.Additionalcoordinationrulescouldalsobedeveloped.ISEDwilldevelopproposedcoordinationrulesthroughconsultationwithstakeholders. Asidefromtherequirementsdescribedinthisguideline,toobtainalicence,earthstationapplicantsmustsatisfytherequirementsoutlinedinCPC-2-6-01. 3.1Acceptabletransmit/receivecontours Thefollowingsectionsdescriberequirementsforacceptablereceiverandtransmitcontours. 3.1.1 Receivecontour Forallreceivingearthstationsregardlessoftheirlocations,theapplicantmustsubmitacontourintheshapeofasimplepolygonspecifyingaregionaroundthereceivingearthstationusingthemethoddescribedinannexD. ContourssubmittedtoISED must beinelectronicformat (e.g..kmz, .kml, .shp).TheapplicantmustalsocompleteandattachthetableinannexE,whichdescribestheassumptionsandparametersusedtogeneratethecontour. 3.1.2 Transmitcontour Foralltransmittingearthstationsregardlessoftheirlocations,theapplicantmustsubmitacontourintheshapeofasimplepolygonspecifyingaregionbeyondwhichtheaggregatepowerfluxdensity(PFD)oftheproposedtransmittingearthstationandanyotherexistingauthorizedco-locatedtransmittingearthstationsdoesnotexceed,formorethan10%ofthetime,avalueof-77.6dBm/m2/MHzat10metresabovegroundlevelthatisgeneratedusingthemethoddescribedinannexD. ContourssubmittedtoISED must beinelectronicformat (e.g..kmz, .kml, .shp).TheapplicantmustalsocompleteandattachthetableinannexE,whichdescribestheassumptionsandparametersusedtogeneratethecontour. Whereanapplicant’sproposedearthstationisco-locatedwithoneormoreotherexistingauthorizedorpendingearthstation,theapplicantisencouragedtocontacttheoperator(s)oftheexistingauthorizedand/orpendingearthstationsforinformationrelatingtotheircontours. Recognizingthatthetransmitcontourisestimatedusingengineeringmodels,ISEDmayrequestatransmittingearthstationlicenseetodemonstratecompliancethroughfieldmeasurements,ifnecessary. Intheeventthattheemissionsfromtransmittingearthstationsexceedthelimitorcauseharmfulinterferencetoflexibleusesystemsoperatinginthesamearea,ISEDmayalsorequireadjustmenttoradioandauxiliaryequipmentinradiostationstoenablecoexistence.ISEDmayconductareviewofthetransmitcontourssubmittedwithearthstationauthorizationsonacase-by-casebasis. 3.2Furtherrequirementsforthetransmit/receivecontours ForproposedearthstationslocatedinaTier4servicearealistedinannexC,thelicenceapplicantisrequiredtoprovideananalysisatthetimetheapplicationissubmittedtodemonstratethatthefollowingrequirementsaresatisfiedforeachflexibleusefrequencyblockinwhichtheproposedearthstationwilloperate: Maximumradiusandareaofthetransmit/receivecontour:Themaximumradiusofthetransmit/receivecontour(i.e.themaximumdistancebetweenthelocationoftheearthstationandtheedgeofthecontour)shouldbelessthan30km.Theareaofthetransmit/receivecontourshouldbelessthan315km2.Ifthemaximumradiusofthetransmit/receivecontourisgreaterthan30kmortheareaofthetransmit/receivecontourisgreaterthan315km2,authorizationmaybeconsideredonacase-by-casebasis,takingintoconsiderationjustificationssubmittedbytheapplicantthatmayinclude,butarenotlimitedto: theengineeringcalculationsandassumptionsusedtoproducethecontour theimpactonanynearbypopulatedareas therationaleforsitingtheearthstationatthelocationspecified demonstrationthattheproposedearthstationwouldnotunnecessarilyencumberfuturefixedandmobileservicesoperatinginthesamefrequencyblock(s) ForproposedearthstationslocatedinaTier4serviceareanotlistedinannexC,thelicenceapplicantisrequiredtoprovideananalysisatthetimetheapplicationissubmittedtodemonstratethatallthefollowingoperationalrequirementsaresatisfiedforeachflexibleusefrequencyblockinwhichtheproposedearthstationwilloperate: Maximumradiusandareaofthetransmit/receivecontour:Themaximumradiusofthetransmit/receivecontour(i.e.themaximumdistancebetweenthelocationoftheearthstationandedgeofthecontour)shouldbelessthanorequalto10km.Theareaofthetransmit/receivecontourshouldbelessthan100km2.Ifthemaximumradiusofthetransmit/receivecontourisgreaterthan10kmortheareaofthetransmit/receivecontourisgreaterthan100km2,authorizationmaybeconsideredonacase-by-casebasis,takingintoconsiderationjustificationssubmittedbytheapplicantthatmayinclude,butarenotlimitedto: theengineeringcalculationsandassumptionsusedtoproducethecontour theimpactonanynearbypopulatedareas therationaleforsitingtheearthstationatthelocationspecified demonstrationthattheproposedearthstationwouldnotunnecessarilyencumberfuturefixedandmobileservicesoperatinginthesamefrequencyblock(s) Sitingrestrictions:InaccordancewithSAB-002-21,aproposedearthstationcannotbelocatedwithintheboundariesofTier4servicearea4-051(Montreal),4-077(Toronto)or4-152(Vancouver);anLPC;oranMPC. AvoidanceofsomeTier4serviceareasandLPCs:InaccordancewithSAB-002-21,theproposedearthstation'stransmit/receivecontourmustnotoverlapTier4servicearea4-051(Montreal),4-077(Toronto)or4-152(Vancouver),and/oranLPCinanothertier. Avoidanceofmajorinfrastructure:Thetransmit/receivecontourmustnotoverlapanymajorinfrastructurewithinarelevantcensusmetropolitanarea(CMA)asdescribedinannex F. Incrementalpopulationlimit:Theincrementalpopulationthatisaffectedbytheauthorizationoftheproposedearthstation,ascalculatedusingthetransmit/receivecontourandthemethoddescribedinannexG,mustbelessthanorequaltothemaximumpermittedincrementalpopulationlimitof2,500people,asspecifiedintable2below. Aggregatepopulationlimit:ForeachflexibleusefrequencyblockinaTier4servicearea,theaggregatepopulationoverlappedbythecontoursofallexistinglicensedearthstationsandtheproposedearthstationmustbelessthanorequaltothemaximumaggregatepopulationlimitintable2belowforeachTier4serviceareaoverlappedbytheproposedearthstation’scontour. Toassistinthelicensingapplicationprocess,achecklisttohelpapplicantsdemonstratecompliancewiththeaboverequirementsisincludedintablesI1andI2ofannexI.Inaddition,examplesdemonstratingcompliancewithrequirementsdescribedinthisguidelineareincludedinannex J. ISEDmayreviewthesubmittedtransmit/receivecontoursandworkwithoperatorstoensurethesubmittedcontoursaregeneratedinconformancewithannexD,ifnecessary. 3.3Meetingtherequirements AllapplicantsforanearthstationlicencewhomeettherequirementsoutlinedinGL-10,issue2willbeeligibleforalicencewiththestandardtermsandconditions. Wheretheproposedtransmittingorreceivingearthstationdoesnotmeetalloftheconditionsinthisguidelinebutdoesmeettheotherapplicablerequirements,ISEDmayconsiderauthorizingtheearthstation(s)onano-interference,no-protectionbasiswithrespecttofutureflexibleuselicenseesoperatinginthesamefrequencyblockonacase-by-casebasis.Insuchinstances,ISEDmayimposecertainspecificconditionsontheauthorization. 4.ContourinformationrequirementforexistinglicenseeslistedinannexesAandB AsdiscussedintheDecision,tobalancetheneedtoensurethespectrumisusedefficientlyandtorecognizetheinfrastructureinvestmentsmadebyexistingearthstationlicenseeslistedinannexesAandB,ISEDwillallowtheircontinuedoperationsforanextendedperiodoftime. AllexistingearthstationlicenseeslistedinannexesAandBwererequiredtosubmittheirtransmitcontourdescribedinsection3.1.2abovebyDecember2019asstatedinGL-10,issue1. ISEDmayreviewthematerialandworkwithlicenseestoensurethesubmittedcontoursaregeneratedinconformancewiththemethoddescribedinannexD. 5.EarthstationslicensedorsubmittedpriortothepublicationofGL-10,issue2 EarthstationslicensedinaccordancewithGL-10,issue1,arenotrequiredtosubmitnewapplicationstoshowcompliancewithGL-10,issue2. ApplicationsforearthstationsoperatingmillimetrewavebandssubmittedbutnotauthorizedpriortothepublicationofGL-10,issue2willbelicensedinaccordancewiththisinterimlicensingguideline. 6.Applicationstomodifyanexistinglicence Modificationstoanyexistinglicences,includingtheearthstationslicensedinaccordancewithsection3,earthstationslicensedinaccordancewithGL-10,issue1,andthoselistedinannexesAandBthatarelocatedinTier4serviceareaslistedinannexC,maybeauthorized,providedthatlicenseessubmitupdatedtransmit/receivecontoursasappropriate(describedinsection3.1and3.2)andareotherwiseincompliancewiththeircurrentconditionsoflicence. Modificationstoanyexistinglicences,includingtheearthstationslicensedinaccordancewithsection3,earthstationslicensedinaccordancewithGL-10,issue1,andthoselistedinannexesAandBthatarenotlocatedinTier4serviceareaslistedinannexC,maybepermitted,providedthatlicenseessubmitupdatedtransmit/receivecontoursasappropriate(describedinsection3.1and3.2),areotherwiseincompliancewiththeircurrentconditionsoflicence,andtheirmodificationsdonotresultinincreasedpotentialforinterferencetofutureflexibleuselicensees.Todemonstratethatthereisnoincreaseinpotentialforinterference,anapplicantmustprovideanddemonstratethefollowing: Frequencyrequired:Theoverlappedflexibleusefrequencyblockisthesameasthoselistedintheexistinglicenceforthecorrespondingearthstation. Updatedtransmit/receivecontour,asappropriate:Thetransmit/receivecontour,asappropriate,resultingfromthemodificationoftheearthstationlicenceoradditionofaco-locatedearthstationhasnopartfallingoutsidetheareacoveredbythecontourfortheoriginalearthstation. Toassistinthelicensingapplicationprocess,achecklisttohelpdemonstratecompliancewiththeaboverequirementsisincludedintableI3ofannexI. Earthstationemissions Annex E:Requiredinformationfordescribingthelistofparametersandassumptionsusedtogeneratethecontour ApplicantsarerequiredtosubmitinformationdescribingtheparametersandassumptionsusedtogeneratetheircontoursineachfrequencyblockusingtheappropriatetemplatesintablesE1a-borE2a-dbelow.Ifthevaluesoftheparametersareidenticaltothosethatappearinthelicenceapplication(s),thisshouldbeindicated.Wheneverpossible,theapplicantshouldusetheactualparametersthatreflectrealoperationandprovidejustification. Transmitpower Thetransmitpowerusedtogeneratethecontourshouldalignwiththevalueusedduringactualoperation(i.e.clear-skyconditions).Ifthetransmitpowerdiffersfromthemaximumpeakenvelopepoweronthelicenceapplicationforanearthstation,adetailedexplanationisrequired. Terrain/Clutter/Shielding TerraindatasuchasSRTM(refertoNASA–ShuttleRadarTopographyMission)orASTERGDEM(refertoNASA–ASTERGlobalDigitalElevationMap)arepubliclyavailable.Therefore,anapplicantisrequiredtotaketerrainintoaccountwhendevelopingthecontour.ISEDrequirestheuseofterraindatabasewitha90mresolutionorless. Wherelanduseclutterdataisavailable,theapplicantshouldincludetheclutterdatainthesimulation.Otherwise,theapplicantshoulduseanappropriatecluttermodeldependingontheenvironmentinwhichtheearthstationislocatedandindicatewhichofthemethodswereusedinthesimulation.Whenusingnon-statisticalcluttermodelslikeITU-RP.452,relevantparameterssuchascluttercategoriesshouldbeprovided.WhenusingastatisticalmodellikeITU-RP.2108inanurbanandsuburbanenvironment,relevantparameterssuchasthepvalueshouldbeprovided.Theapplicantshouldalsoexplainwhythechosenmodelisappropriateandprovidejustificationfortheparametersselected.
