YoumayhaveheardofNoChildLeftBehind,butmightbeconfusedastowhatitmeanstoyouandhowitaffectsyourchildren'seducation.ThisreportwillexplainwhatNoChildLeftBehindis,whyitwascreated,andhowyourchildcanbenefitfromit.Itwillalsodiscusssomepotentialcontroversiessurroundingthelegislation.Onthe12thbirthdayofNoChildLeftBehind,manyarestillwonderingwhatthisfederallawisandhowitaffectstheeducationoftheirchildrentoday.WhileNCLBisnowthickinthereformprocess,confusioncontinuesoverhowtoaltereducationpoliciesforthebestinterestofthestudentstheyweredesignedtoteach.ThefirststepistounderstandwhatNoChildLeftBehindis,whyitwascreated,andhowyourchildmaycontinuetobenefitfromit.Itwillalsodiscusssomepotentialcontroversiessurroundingthelegislationandthereasonswhyreformappearssohardtocomeby.  WhatIsNoChildLeftBehind? NoChildLeftBehindwasfirstintroducedasHouseResolution1duringthe107thCongressinMarchof2001.TheNoChildLeftBehindActaimedtoensurethatallstudents,regardlessofraceorsocioeconomicstatus,wouldhavetheopportunityforasolideducation.PresidentGeorgeW.BushsignedtheNoChildLeftBehindActintolawinJanuaryof2002.  PhotobyExecutiveOfficeofthePresidentoftheUnitedStates,[Publicdomain],viaWikipediaCommons  NoChildLeftBehindisabipartisaneffort.Theactpassedwithsupportfromdemocratsandrepublicansalikeandabipartisancommissionwascreatedin2006toreviewNoChildLeftBehind,itspromises,anditsproblems.ThiscommissionprovidedCongresswithrecommendationspriortotherenewalofNoChildLeftBehindin2007.Unfortunately,NCLBhasgroundtoahaltsincethattime,aslawmakershavebeenunabletoagreeonpreciselyhowtoreformthefederalmandate. TheNoChildLeftBehindMandate. NoChildLeftBehindmandatesthatallteachersmustbe"highlyqualified"bytheendofthe2005/2006schoolyear.Accordingtothelaw,"highlyqualified"meansthatateachermustmeetthelicenseandcertificationrequirementsofthestateinwhichtheyteach.Ateachermustalsoholdatleastabachelor'sdegreeandmustpassstatetestingcriteriatobeeligibletoteachbeyondthe2005/2006schoolyear. Ifateacherdidnotmeetanyofthesequalificationsbytheendofthe2005/2006schoolyear,theywillnotbeallowedtoteachagainuntiltheydomeetthesemandatoryrequirements. NoChildLeftBehindalsomandatesthatallstudentsinaschoolmustbe"proficient"bythe2013/2014schoolyear.Eachstatewilldetermineitsownstandardsof"proficiency"forthestudentsinthatstate.Ifatthatpoint,aschoolrepeatedlyproducesstudentswhoarenotproficientintheirstudies,thestudentsatthatschoolwillhaveadditionalassistanceprogramsavailabletothem,suchastheabilitytoattendoneofatleasttwootherschoolsintheirdistrict. ThelongeraschoolfailstomeettheNoChildLeftBehindcriteria,themoreassistancewillbemadeavailabletoparentsandstudentsinthatschool'sdistrict.Theseschoolswillalsofaceadditionaldisciplinarymeasures,including,butnotlimitedto,statetakeover. WhatDoesNoChildLeftBehindDo? AccordingtotheU.S.DepartmentofEducation,NoChildLeftBehindwasdesignedtoprovideschooldistrictswithmorefundingintheformofNoChildLeftBehindbonuses,aslongasthoseschoolsareachievingthestandardssetbyNoChildLeftBehind.NoChildLeftBehindwillalsoallowstatesandschooldistrictsmoreflexibilityintheuseoftheirresources,holdschooldistrictsandindividualschoolsaccountablefortheirresults,giveparents"reportcards"gradingtheschoolsintheirschooldistrictssotheycanseewhichschoolsintheirneighborhoodsaresucceeding,provideextrahelpwithlearning,offerschoolchoiceandencourageparentalinvolvement. Ifschoolsthatarefoundlackingfailtoimproveeachandeveryyearbetweennowand2007,aschoolimprovementplanwillbeimplemented.Iftheschoolstillfailstoimproveaftersuchaplanhasbeenimplemented,theschoolmaybesubjecttostatetakeover. ControversySurroundingNoChildLeftBehind. TherehasbeenplentyofcontroversysurroundingNoChildLeftBehind.Teachers,schools,educationalorganizationsandevenentirestateshavecomeforthanddeclaredNoChildLeftBehindtobe"flawed"and"ineffective"forvariousreasons.Asreformofthelawmovesforward,debatesabouthowtomakeNCLBmoreeffectivecontinueacrosstheaisleandevenamongdifferentschoolsanddistricts. MoneyConcerns. PerhapsthebiggestcontroversysurroundingNoChildLeftBehindistheissueofadequatefunding.WhiletheintentionsofNoChildLeftBehindmaybelaudable,ifthefundingisn'ttheretobackit,theplanmaybecomemoreofaburdenthananaid.AccordingtoastudyconductedbytheNationalAssociationofStateBoardsofEducation(NASBE),thatappearstohavebeenanearlyproblemwiththeprogram. TheStudytheNASBEconductedestimatedthatitwouldcostapproximately$7billiondollarsoveraseven-yearperiodforallofthestatestodevelopandimplementthetestingprogramsoutlinedinNoChildLeftBehind.However,theNoChildLeftBehindbudgetonlyauthorizes$400milliondollarstogotowardshelpingthestatesdesignandimplementthetests.Accordingtothestudy,thatwouldmeantheschoolswouldberesponsibleforfootingabillofmorethan$6billiondollars. TheNASBEisn'ttheonlyeducationalorganizationraisingeyebrowsatNoChildLeftBehind.AccordingtostatementsmadebyBeckyFleischauer,thespokeswomanfortheNationalEducationAssociation,inaninterviewwithEducationWorld,FleishauerfeelsthatthegoalsofNoChildLeftBehindareadmirable,butthemeanstomeetthosegoalsjustaren'tthere.Thespokeswomanfailstoseehowthegoalswillberealizedwithoutcompletefederalfundingsincestatesarefacingdeficitsandongoingissueswithbudgetcutsasitis. SacrificingOneSubjectforAnother. AnotherissueleadingtotheNoChildLeftBehindcontroversyisthefactthatsometeachershavefeltpressuredtofocusonsubjectsratedbytheNoChildLeftBehindtestingrequirements,ratherthanfocusingonprovidingchildrenwithawell-roundededucation.SomeschoolshavebeenaccusedofcuttingbackonstudiesinvolvingscienceandtheartstoincreasethefocusonEnglishandmath.Asaresult,somecomplaineducationisn’treallyimproving;itjustmeanssacrificingonesubject'sproficiencyforanother. ThisvideoexplainsNoChildLeftBehind.     TooMuchFederalControl. Anotherconcernthathasbeenbroughtupbyindividualsandorganizationsacrossthecountryisthatoffederalizingeducation.AccordingtoBruceHunter,theAssociateExecutiveDirectoroftheAmericanAssociationofSchoolAdministrators(AASA),theAASAdidindeedsupportthegoalsofNoChildLeftBehind,buttheorganizationcouldnotendorseitduetothefactthatthelawexpandsthefederalgovernment'sroleineducation,amatterthatshouldbeleftuptotheindividualstates. SomepeoplearegoingsofarastosayNoChildLeftBehindisunconstitutional.AccordingtotheConstitution'sTenthAmendment,ifsomethingisnotcoveredintheConstitution,itneedstobehandledatthestatelevel.SincethereisnothingabouteducationalstandardsintheU.S.Constitution,manyopponentsfeelthatthefederalgovernmenthasoversteppeditsboundaries. ItisimportanttonotethatpeopleontheothersideofthefencearguethatNoChildLeftBehindactuallygivesschoolsmorefreedomduetothefacttheschoolswillhavemoreflexibilityindeterminingtheuseofthefederalfundstheyreceive.Itisalsoimportanttonotethatthestateswillbedefiningtheirstandardsastowhatconstitutes"proficient,"notthefederalgovernment. WhileitistruethatNoChildLeftBehindhasbeenrunatthefederallevel,statesdohavethepowerwithintheprogram.Itisalsoimportanttonotethatthefederalgovernmenthashadahandineducationalstandardsforquitesometime,soNoChildLeftBehindisnotthefirstinstanceoffederalinfluenceonschoolstandards. NecessaryChanges. TheNationalEducationAssociationbelievesthatinorderforNoChildLeftBehindtobesuccessful,theapproachandtheplansneedtobechanged.TheorganizationhasestablishedfiveprioritiestheybelieveneedimmediateattentionbeforeNoChildLeftBehindcanachieveanyofthegoalsitisintendedtoaccomplish. ThefiveprioritiesestablishedbytheNationalEducationAssociationincludeimplementinganaccountabilitysystemthatwouldrewardeducators,cuttingdownclasssizestoimprovestudent/teacherinteractionandstudentlearning,puttingqualifiedteachersineveryclassroom,theencouragementoffamiliesandcommunitiesintheeducationoftheschool'schildren,andprovidingadequateresourcestoensureallpublicschoolscanprovidequalityeducation. WhatDoesNoChildLeftBehindMeanToYou? WhatdoesNoChildLeftBehindmeanforyouandyourchild?Firstandforemost,itmeansmorefreedomandpowerforparentsandtheassuranceofagoodeducationforyourchild.IfstudentsinaTitleIschool(aschoolwithahighnumberofstudentsfromlow-incomefamilies)aren'tmakingacademicprogressonanannualbasis,NoChildLeftBehindgivesparentsthepowertochangetheschooltheirchildattendsandtheabilitytoprovidetheirchildwiththeextrahelptheirchildrenneed. PublicSchoolChoice.  PhotoByDaderot(Ownwork)[Publicdomain],viaWikimediaCommonsPublicchoiceisprovidedtochildrenwhoattendaTitleIschoolifthestatehasdeemedthatschoolasbeingunsafeorasneedingimprovement.Ifyourchildattendsoneoftheseschools,youcanchoosetosendyourchildtoanotherpublicschoolinadifferentschooldistrictatnocosttoyou. Eachandeveryyear,yourschooldistrictmustnotifyyou,lettingknowwhetherornotyourchildiseligibletotransfertoadifferentschool.Ifyourchildiseligiblefortransfer,thedistrictisrequiredtoprovideyouwithatleasttwodifferenttransferschoolstochoosefrom.Inadditiontoallowingyourstudenttotransfertoanotherschool,theschooldistrictwillalsoberequiredtopayforyourchild'stransportationtoandfromtheschool. Ifaschoolisunabletopayforallofthestudentstransferringschools,priorityisgiventounderachievingstudentsandtostudentsfromlow-incomefamilies. SupplementalEducationalServices. IfyourchildishavingtroubleinschoolandisattendingaTitleIschoolthathasbeeninneedofimprovementforaperiodofatleastoneyear,yourchildmaybeeligibletoreceivesupplementaleducationalservices.Whetherornotyouareeligibleforsupplementaleducationalserviceswilldependonyourspecificincomelevel.Thisprogramisintendedforlow-incomefamiliessosomefamiliesmaynotqualify. Supplementaleducationalservicescanincludetutoringorremedialhelpforyourchild.Ifyouareeligibleforsupplementaleducationalservices,yourschooldistrictmustprovideyouwithalistofallstate-approvedsupplementaleducationalserviceprovidersinyourarea.Youhavetherighttopicktheproviderthatyoufeelwouldbebestforyourchild. Supplementaleducationalservicescanincludetutoringorremedialhelpforyourchild.Ifyouareeligibleforsupplementaleducationalservices,yourschooldistrictmustprovideyouwithalistofallstate-approvedsupplementaleducationalserviceprovidersinyourarea.Youhavetherighttopicktheproviderthatyoufeelwouldbebestforyourchild. CharterSchools. Charterschoolsareaninnovativeconceptthatmanyparentswillfindvaluable.Theseschoolsarepublicschools,buttheyhavefreedomsthatallowparents,leadersofthecommunity,andeducationalentrepreneurstoprovidestudentswithmoreeducationaloptions.Whilecharterschoolsarepubliclyfunded,theyareexemptfromcertainrulesandregulationsonthestateandlocallevels.Theseschoolsweredevelopedtoreformpubliceducation,withtheschoolsbeingaccountableforoutcomesratherthanprocesses. NoChildLeftBehindwillprovidecharterschoolswithfinancialassistanceforstart-upcosts,facilities,andothercostsinvolvedwithcreatingahigh-qualityeducationalinstitution. MagnetSchools. Amagnetschoolisintendedtodoexactlywhatitsoundsliketoattractstudents.Magnetschoolstendtofocusonaspecificsubjectandfollowaspecifictheme.Theschoolsaremeanttoattractstudentsfromdifferentbackgrounds(socially,economically,andracially),creatingadiverseeducationalenvironment. Magnetschoolscanprovidestudentswithspecificskillsthatwillhelpthemtowardsasuccessfulcareer.Forinstance,somemagnetschoolsmayfocusonengineeringwhileothermagnetschoolsmayfocusonhumanities.Becausetheenrollmenteligibilityfortheseschoolsisn'tlimitedtogeographicboundaries,theyattractadiversestudentpopulation. Somemagnetschoolsoperateasa"schoolwithinaschool."Thisisbecausetheactual"magnetschool"programisheldwithinalarger,comprehensiveschool. Unlikecharterschools,magnetschoolsareconsideredapartofthepublicschoolsystem.Theyoperateunderthesamehierarchyandfollowthesamerulesandregulations. UnderNoChildLeftBehind,PresidentBushhasrequestedthat$100millionbebudgetedtoenableschooldistrictstoestablishnewMagnetSchools.Asoftoday,morethan150,000studentshavebenefitedfromthisprogram. EvaluatingSchools. Ifyouarethinkingofmovingorifyouwanttoknowhowyourchild'sschoolrankscomparedtootherschoolsinyourarea,youneedtoknowwheretoturntogetinformationonaschool'sNoChildLeftBehindcomplianceandprogress. OrganizationscalledParentInformationandResourceCenters(PIRCs)worktoinformparentsabouttheratingsandprogressofdifferentschoolsintheirarea.Therearecurrentlymorethan80PIRCsinthecountryprovidingthisservice.TofindthePIRCinchargeofyourschooldistrict,visitthePIRCwebsiteatwww.pirc-info.net/pircs.asp. Onceyouareatthatwebsite,youwillbeabletoperformasearchbystate.ThesearchresultswillprovideyouwiththecontactinformationofthePIRCresponsiblefortheareainwhichyouliveortheareayouareinterestedinmovingto.ThatPIRCwillbeabletoprovideyouwiththeinformationyouneedinregardstoyourschool'scompliancewithNoChildLeftBehind. ReformEfforts TwelveyearsintotheNoChildLeftBehindexperiment,reformstillseemstobeadistantgoal.Themandateexpiredin2007,butCongresshasyettocometoanagreementonhowtorewritethelaw.Untilthenewlawwasinplace,schoolswererequiredtocontinuetoabidebytheoriginaltermsofNCLB.By2011,Congressstillhadn’tpassedneweducationreform,andPresidentBarackObamatookaction. Manyschoolsacrossthecountryfacedthenewproficiencyrequirementsforthe2013-2014schoolyear,knowingtheywouldnotbeabletoreport100%proficiencyfortheirstudents.TheObamaadministrationgaveschoolsanotheroption–abidebycertainreformslikeincludingstudenttestscoresforteacherevaluationsandoptoutofsomeoftheNCLBrequirements.Mostschoolsjumpedattheoption,with42statescurrentlyholdingwaiversforNCLBexemption. ItappearsthatwaiverswillcontinueindefinitelysinceCongressdoesnotappearanyclosertocomingtoanagreementonreformforNCLB.ManyexpectthewaiverstocontinueuntiltheendoftheObamaAdministration.Atthatpoint,itwillbeanyone’sguessastohowthenextadministrationwilltackleeducationreform. Questions@ContactusonFacebook.@publicschoolreview
